i.Plain English, on purpose
These terms apply whenever you buy something from gorseandquill.com. They’re written in plain English on purpose. If anything’s unclear, just get in touch.
ii.Who you’re buying from
Gorse & Quill is a trading name of Keith McInally, a sole trader based in Scotland. You can reach us at hello@gorseandquill.com.
iii.Placing an order
When you place an order, you’ll receive an order confirmation email. This confirms we’ve received your order. It doesn’t mean a contract is formed yet. A contract between us is only made when we send you a dispatch confirmation, telling you your order is on its way. This means that if, for example, an item turns out to be out of stock before dispatch, we’re able to let you know and offer a refund rather than being bound to a sale we can’t fulfil.
We reserve the right to refuse or cancel an order at our discretion, for example in cases of suspected fraud, pricing errors, or stock issues. If we cancel an order after payment, you’ll receive a full refund.
iv.Pricing and payment
All prices on the site are shown in GBP. Where VAT applies, it will be included in the displayed price. Payment is taken securely via Stripe at the time of order.
Occasionally a price may be listed incorrectly due to a technical error. If this happens, we’ll contact you before processing the order to ask whether you’d like to proceed at the correct price or cancel.
v.Delivery
We currently only ship within the United Kingdom. We aim to dispatch orders within 3 working days of receiving them. Delivery timeframes shown at checkout are estimates, not guarantees. Risk in the goods (i.e. responsibility for loss or damage) passes to you once the item is delivered to the address provided at checkout.
If a delivery is significantly delayed or lost in transit, please get in touch and we’ll do what we can to help, including a replacement or refund where appropriate.
vi.Returns and exchanges
You can return or exchange your Ledger within 30 days of delivery, for any reason (you don’t need to give one), provided it’s unused and in its original condition. This applies to our products, as they are not made or personalised to individual customer specification, and is in addition to your legal right to cancel within 14 days of delivery under the Consumer Contracts Regulations.
To start a return or exchange, just email us within that 30-day window. Return postage is at your own cost, unless the item arrived faulty or damaged. We’ll process your refund or exchange within 14 days of receiving the item back.
Once a Ledger has been written in, we’re unable to accept it as a return or exchange: a used notebook holds no resale value, however lightly it’s been written in. We’d simply ask that you’re sure before you put pen to paper.
This is separate from what happens if an item arrives damaged or faulty in the first place: if that happens, email us at hello@gorseandquill.com with photos of the issue and we’ll arrange a replacement or full refund at no cost to you, in line with your rights under the Consumer Rights Act 2015.
vii.Intellectual property
All content on this site (including text, design, photography, and the journal’s prompts and layout) belongs to Gorse & Quill and may not be reproduced or used commercially without permission.
viii.Our liability
We want every order to arrive in good condition and as described. Nothing in these terms is intended to limit your statutory rights as a consumer. We aren’t liable for indirect or consequential losses, or for delays caused by circumstances outside our reasonable control (for example, postal strikes or extreme weather affecting delivery).
ix.Governing law
These terms are governed by the law of Scotland, and any disputes will be subject to the jurisdiction of the Scottish courts.
x.Changes to these terms
We may update these terms from time to time, for example to reflect changes in how we operate. The version in force at the time you place an order is the one that applies.
